By shopping with us and using this website, you acknowledge that you have read and agree to Print Darling’s terms and conditions before placing an order with us.

Definitions

Print Darling will be referred to as us/we/our or Print Darling
www.printdarling.com.au will be referred to as our/this website or print darling.com.au
Our products are referred to as prints
and you, our customer or client will be referred to as you/the client and is the person placing the order with us.

Application

Print Darling and you the client are bound by these terms and conditions for all orders placed, on this our official website, and retain all statutory rights under common law. These terms and conditions are valid for print orders provided by the us to you, the client.

Usage

The prints you order from Print Darling and sold to you by us are for your personal decorative home or office use and not for resale, unless other arrangements have been specifically made for wholesale or retail and there is a record of such an agreement.

Prices

All prices listed on our website are in Australian Dollars

Print Darling reserves the right to change prices at any time without prior notice at our discretion.

Prices do not include delivery. Delivery charges will be applied accordingly.
By placing an order, you agree to pay the stated price (plus any applicable shipping and handling charges) in Australian Dollars for all orders.

We reserve the right to change the prices of our Prints at any time without notice.

From time to time due to programming errors our website could indicate an incorrect price, this incorrect price is not binding on us even after completion of the order and in the case of such an error you the client is not bound to accept the print and will be responsible for the their return.

Payment

All payments must be made in full prior to delivery of your print purchase. We accept major credit cards, Visa, MasterCard, Paypal. We  also reserve the right to change our mode of payment at any time.

To the extent permitted by law, we will not be held liable and responsible for any damages or consequential loss (whether direct or indirect) suffered by you as a result of any credit card fraud or unauthorised access to a Palpal account.

We will not be held liable or responsible for any additional charges imposed by your credit card provider or bank, especially in the case where your purchase involves foreign exchange transactions.

If your payment is not received in full or is declined by your bank, credit card issuer or Paypal, we will not hold the Print against your order.

Delivery

Print Darling can only deliver within Australia.

We reserve the right to select the method of delivery and the client agrees to pay the freight price invoiced by us.

Delivery by us will be deemed to have taken place when your prints are delivered to your nominated address on the order form.

Our prints will be carefully, rolled, wrapped and placed in a secure tube. They will be in perfect condition prior to postage and we take no responsibility for damage during careless unwrapping after delivery.

Delivery & Order Times

You acknowledge that Print Darling will take approx 1 week as production time, starting from the time the order has been made. Moreover, you agree that shipping time may also depend on your response time to our inquiries regarding your order.

You agree to allow 3-7 days for the delivery of your order, or additional if there is an inquiry or similar delay.

Cancellation

You agree that you have carefully reviewed the product details before actually placing your print order with us. Print Darling is not responsible for revising or cancelling orders once an order has been placed.

Your order will be printed as it is received and cancellation of any orders by the client will only be accepted at the sole discretion of Print Darling. We may charge the client any costs, and expenses already incurred.

Colour

Each computer monitor is calibrated differently and all screen settings are different The colours displayed on your screen may be different to that of the final printed product.

You agree that Print Darling does not guarantee that the final colours of your purchased print will be exactly the same as were shown on your screen.

Print Darling will ensure the colours on the print to be correct as per the
original and actual image and are tested and confirmed exact prior being presented for sale.

You also acknowledge that Print Darling prints are for indoor use only and will fade in direct sunlight.

Paper stocks

When making a print purchase from Print Darling you agree that you have read our website and know about the paper stocks on which the printing is done. You agree that Print Darling will not be responsible if the materials thought by you, the client was something other than advertised on our website.

Editing and Incorrect files

If you are supplying your own image for Print Darling to print, we will correspond with you to ensure it is acceptable quality to print as you require, and confirm pricing. We will have a written email agreement from you to proceed, and agree to payment prior to print. We rely on the client to provide the

correct file and will not be held responsible if the client has a change of mind or after agreeing for us to proceed advises that an incorrect file has been
provided. If you request Print Darling to edit your file, the client agrees to
accept this editing and accepts any charges incurred for our time and effort.

Warranties, returns & refunds

Print Darling will supply prints using professional care and skill.

The life of the prints will vary depending on the environmental conditions and care to which they are subjected to.

The client acknowledges that the expected life of the prints supplied by us will be adversely effected in the event that the prints are subjected to

• Periods of sunlight (direct or strongly reflected,
• Airborne pollutants and/or gases
• Humidity or moisture
• Ultra Violet light
• Rapid changes in temperature.

The client acknowledges that the life of print supplied by us will be extended where conservation choices are selected, for example Conservation glass instead of Premium Clear glass.

It is solely the client’s responsibility be aware of this.

Print Darling will only despatch a perfect print to you protected in a sturdy mailing tube. If the product arrives damaged, a claim is to be made on the courier/ deliverer.   Our prints will be carefully, rolled, wrapped and placed in a secure tube. They will be in perfect condition prior to postage and we take no responsibility for damage during careless unwrapping after delivery.

We will not refund or exchange due to change of mind. We may however offer some recompense in special situations which will be based on particular situation.

Social Media

Print Darling operates social media accounts on Facebook and Instagram, and may use other social media in future. We do not endorse the opinions expressed by the users on our social media pages.

By submitting content, you agree that we may use and reproduce this content including your name, for testimonial, or other purposes in any media and without any compensation to you.  Any content you submit must be your original work.

You must not post any material that is defamatory, derogatory, racist, sexist, unlawful, obscene, infringing any third party’s intellectual property rights, breaching someone else’s confidentiality or privacy, misrepresenting your relationship with us or this website, misleading, false or deceptive on our social media pages.

We reserve the right to edit or remove content that violates these Terms and to block your access to our page.

Intellectual property rights

All text, graphics, logos, icons, images, photographs and software that feature on our website are protected under Australian copyright laws. You must not reproduce, store, adapt, distribute, display, publish, or create similar works from them.

If you upload any material or content on our Website or social media accounts, you grant us an irrevocable, royalty-free licence to use and reproduce that material or content. Having said that, we do not claim ownership of intellectual property rights in respect to user content.

Availability of this Website

Occasionally down-time on this printdarling.com.au either scheduled or unscheduled, may occur. We will not be held liable for the consequences of any down-time.

Links to third party Websites

printdarling.com.au may contain links to other websites. Unless stated otherwise, we do not control, endorse, sponsor or approve such third party websites or their contents, nor are we liable and responsible for any loss or damage that you may suffer as a result of your visits to any third party websites.

Interference with this Website

You agree not to make or attempt to modify, hack, remove, deface, add or otherwise interfere with printdarling.com.au or to any material or content posted on this website.

Limitation of Liability

Print Darling shall not be liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in the prints nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue, death or personal injury) whether from negligence or otherwise in connection with the supply, functioning or use of the prints. Any liability of Print Darling shall in any event be limited up to the price paid for the goods or services relating to the event. The client shall fully indemnify the Print Darling against any liability to third parties arising out of the client’s use of the prints.

Copyright

Print Darling is protected by Australian and international copyright laws and by other applicable laws. You may not process any content owned by someone else without the written consent of the owner of such content. You are solely responsible for any copyright violations that may incur as a result of your activities with us.

All images, photography, and art prints presented on this website for sale to you are protected by copyright, and presented with appropriate licenses, permissions and approvals.

Indemnity

You will indemnify, defend, and hold harmless, Print Darling, including its officers, directors, employees, affiliates, licensors, suppliers, information providers, and agents from and against all losses, claims, liabilities, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of the terms or any activity related to the service (including negligent or wrongful conduct by you or by any other person accessing our print service as you invitee, such as by using your account.
